Overview The Judicial Council of California is seeking an Attorney II – Labor & Employment Unit to provide legal services and advice to judicial branch clients, with a focus on employment and labor law. The attorney will independently manage a workload in a collaborative environment and may work across practice groups to support judicial branch clients. Attorneys in Legal Services may support work across units, including providing written opinions, drafting rules of court and legislation, and managing litigation as needed. The successful candidate will work in either the San Francisco or Sacramento office at least two days per week, depending on office lead direction, and reside in the surrounding area. Responsibilities Provide in-house counsel and labor and employment law advice to trial and appellate courts and the Judicial Council. Advise on a diverse range of employment issues (employee discipline and termination, disability accommodations, leaves of absence, FMLA/CFRA, grievances, employee benefits, wage and hour issues). Advise on labor matters, including interpretation of collective bargaining agreements, employer-employee relations rules and procedures, grievances, and unfair labor practice charges. Manage investigations of employment-related complaints. Evaluate and manage employment litigation and labor arbitrations. Retain and actively manage outside counsel in all stages of litigation. Assist and advise trials courts and work with outside counsel in proceedings before the Public Employment Relations Board. Evaluate, review, and develop personnel policies and related materials. Present labor and employment trainings for judicial branch clients and the Judicial Council. Consult with or advise committees, advisory bodies, and work groups on labor and employment issues. Additional duties or support may be requested, including drafting rules of court and legislation, preparing written opinions, and supporting advisory bodies focused on civil law, court operations, and related areas. Minimum Qualifications – Education and Experience Juris Doctor, and three (3) years of relevant post-bar legal experience as a practicing attorney. After passing a state bar, work experience as a Law Clerk to a federal or state judge prior to bar admission will be considered qualifying. Licensing and Certifications Current active membership with the State Bar of California prior to hire. Desirable Qualifications Substantial experience in labor and/or employment law. Exceptional communication, interpersonal, negotiating, and public speaking skills. Strong legal research, writing, and analytical abilities. Experience in or with the public sector. Skills Excellent critical thinking, problem solving, and judgment. Strong communication, interpersonal, diplomacy, and public speaking skills. Ability to present issues clearly and advocate positions concisely and logically. Ability to manage workloads, deadlines, and competing demands. Ability to work autonomously while being a team player with a positive attitude. Ability to listen to different points of view, build consensus, and resolve conflicts. Ability to maintain effective working relationships. Knowledge Of Federal, state, and local laws related to labor and employment law. Principles and practices of California and federal labor and employment law. Legal research methods (including electronic research), writing, and editing. Litigation management, civil procedure, constitutional law, and administrative law principles. Pay & Benefits Monthly Salary Range: The posted salary range is subject to temporary 3% reduction due to statewide fiscal conditions. In exchange, judicial branch employees accrue an additional 5 hours of paid personal leave per month through June 30, 2027.
