The Deputy General Counsel will assist the General Counsel in coordinating and managing legal work throughout the Department. This includes the following responsibilities:
Supervise attorneys within the Office of Legal Affairs by assigning and reviewing work and directing and advising them regarding litigation strategy and decision-making in their assigned cases;
Research and analyze applicable federal and state statutes, regulations, caselaw, constitutional requirements, and legislative or regulatory proposals in order to advise and direct the Executive Team and managers to ensure that the Department’s programs, policies, and operations are administered in compliance with applicable legal requirements and reduce exposure to risk;
Represent and defend the Department of Corrections in state and federal habeas litigation under delegated authority from the Office of the Attorney General, in contested cases before the Office of Administrative Hearings, and in charges of discrimination filed with state and federal agencies;
Act as a Department liaison with the Office of the Attorney General regarding litigation matters and strategy; and
Evaluate and assess the merits of civil actions brought against the agency, including analysis of risks and benefit of on-going litigation versus resolution through a negotiated settlement agreement.
Minimum Qualifications
To be qualified for and considered for this position, ensure that your resume contains descriptions of your work experiences sufficient for comparison against the requirements stated below and indicate the beginning and ending month and year for each job held.
J.D. from an ABA-accredited law school and current license to practice law in the state of Minnesota.
Six (6) years experience as a licensed practicing attorney, including:
Researching and communicating legal advice on novel or complex issues to clients including managers or executive level leadership; and
Conducting or managing litigation, including drafting or review of legal documents such as briefs, memoranda of law, dispositive motion practice, or court opinions
Excellent legal writing, legal analysis, and written and oral communication skills
Demonstrated commitment to fostering a diverse and inclusive workplace
Preferred Qualifications
The following qualifications are strongly desired of applicants seeking consideration for this position:
Experience in law relating to the administration of corrections programs, policies, and operations, including state and/or federal habeas litigation
Prosecutorial experience or other knowledge of administration of criminal sentences and the corrections system
Project management and organizational skills, including ability to identify and prioritize essential projects
Extensive knowledge of federal and state anti-discrimination laws.
Employment-law related experience in a public-sector work environment.
Experience advising or representing government entities regarding public sector and government services issues such as procurement, data practices, and administrative rulemaking.
Experience representing clients in civil litigation or administrative proceedings including those before the Minnesota Department of Human Rights, Equal Employment Opportunity Commission, U.S. Department of Justice, and Office of Administrative Hearings.
Experience drafting or providing legal advice related to drafting legislation, administrative rules, and/or agency policy
Management, supervisory, or lead experience

The selection process may include screening the top candidate(s) on their criminal history, predatory offender registration, offender associations and/or other applicable background information in accordance with Department of Corrections’ policy. Top candidate(s) must pass a criminal history check which includes successful completion of all sentencing and/or restitution requirements of law enforcement jurisdictions, including probation.
Employment history/reference checks, including incidents of sexual harassment, will also be conducted on the top candidate(s) in accordance with Department of Corrections’ policy. This may include a review of job performance and discipline records.
New employees will be fingerprinted within the first 30 days of employment.
