The Head of Intellectual Property (IP) Diagnostics is responsible for counseling the global businesses of the Siemens Healthineers Business Area Diagnostics (DX), within the Business Lines Core Lab Solutions (CLS), Specialty Lab Solutions (SLS) and Point of Care Diagnostics (POC) in all aspects of IP law as well as managing a team of patent attorneys in the United States and Germany. This position is responsible for counseling associated with a wide range of IP assets with a focus on patents, designs and trademarks, developing and implementing IP strategies to protect, defend and exploit IP assets, handling complex IP litigation, drafting and negotiating contracts, and partnering with senior leadership in DX and its business lines in planning and executing innovation strategies. This position reports directly to the Head of Intellectual Property and requires strong collaboration skills to engage with stakeholders across all levels of the organization, including the legal department and external counsel. This position will be hybrid and based in Tarrytown, New York.
Job Functions
Together with Research, Development and Innovation leadership, develop and implement a comprehensive IP strategy for the Business Area Diagnostics and its Business Lines and serve as a strategic advisor to business leadership on all IP-related matters including the preparation, coordination and execution of decisions. Cooperate across corporate business units and departments and throughout a large group of affiliated companies to achieve targeted results while minimizing risk. Lead and further develop a global team of five patent attorneys and two paralegals and foster cross-functional collaboration with legal, R&D, marketing, finance, quality, regulatory, and compliance. Drive the implementation of an IP protection strategy, including idea generation, management of patent preparations, filings, and global prosecutions. Lead IP risk analysis and mitigation within DX to ensure freedom to operate by continuously monitoring third-party IP portfolios, carrying through product clearance, advising R&D in the development process, invalidating and/or licensing third-party IP. Safeguard business goals by managing third-party IP claims and complex IP litigation. Support external collaborations with academic institutions and industrial partners by training and advising collaboration managers, drafting, reviewing and negotiating IP clauses. Bring decisive value to M&A transactions by carrying through IP due diligence and clearly articulating relative strength of opportunities and risks.
Competencies
Proven ability to independently and effectively lead and develop a team in a corporate IP department. Outstanding communications skills and demonstrated skill in effectively framing and resolving complex IP topics with both executive leadership and inventors to drive businesses strategic innovation strategies. Excellent leadership skills with the ability to foster trust across functions and cultures, and to establish the highest standards for integrity and ethics. Proven ability to recruit and develop IP talent. Highly developed skills in negotiation, communication, listening, including those suitable for interaction with senior managers and global executive leadership. Profound experience in IP counseling, licensing, litigation, product clearances, prosecution, and drafting, reviewing and negotiating IP-related agreements. Fluency with skills and tools appropriate to manage and appropriately exploit and defend a large body of IP assets. Advanced knowledge of IP law in both Europe (EP) and China (CN). Experience in the healthcare or biotech industry is preferred but not required. Background in the molecular field is a plus. Willingness and ability to travel domestically and, from time-to-time, internationally.
Qualifications
Minimum of 7 years of experience in practicing IP law with distinction, thereof at least 2 years in a leadership position. Distinguished in-house experience in healthcare sector preferred. Juris Doctor (JD) degree from an accredited institution. Admission to practice law in a U.S. state and before the USPTO. Bachelor’s degree preferably in Biochemistry, Biology, Molecular Biology, Chemistry, alternatively / additionally Engineering, Software Architecture, Robotics or a related field from an accredited institution.

The Annual Base Pay For This Position Is
Min $240,000 - Max $360,000
Factors which may affect starting pay within this range may include geography/market, skills, education, experience, and other qualifications of the successful candidate.
If this is a commission eligible position the commission eligibility will be in accordance with the terms of the Company's plan. Commissions are based on individual performance and/or company performance.
