Major, Lindsey & Africa’s Interim Legal Talent group is seeking an interim Commercial Counsel - Payments. Overview : Our client is seeking an interim Commercial Counsel - Payments to provide coverage during a period of leave for someone on their in-house legal team. Company: Private fintech company. Experience: The ideal candidate will have a minimum of 7 years of experience with payments laws, financial regulations, data security/privacy, and money transmission. Location: Remote US (may be required to work east coast hours needed). Responsibilities Include: Draft, revise, and negotiate agreements on behalf of the Financial Services business units (payments, accounts, prepaid, bill payment, mobile, etc.) (35%) Review and revise cardholder agreements, marketing materials, website terms of use and other collateral items for compliance with federal and state data privacy, consumer protection & disclosure regulations (35%) Assist Compliance division with maintaining money transmission licenses, responding to audits and applying for new licenses (10%) Conduct regulatory analysis and prepare memorandums for new products and services to determine compliance and legal requirements (20%)
Qualifications Include: Minimum of 7 years of relevant experience, especially as it relates to reviewing, drafting and negotiating agreements on behalf of Financial Services business units, cardholder agreements, and marketing materials. Working knowledge of Regulation E, FinCEN and the laws governing the use of gift cards. Some prior in-house experience is required. Background in fintech or financial services is highly preferred. Prior big law experience is a strong plus. JD from ABA accredited school and active license in at least 1 US jurisdiction.
