Duties and Accountabilities Represent clients at all stages of domestic and international litigation on matters involving technology, data privacy, intellectual property and cyber security laws. Assist with complex commercial litigation in federal and state courts, as well as advise clients on corporate transactions. Review client files and documents to prepare case assessments and strategy recommendations. Guide technology companies through regulatory investigations by governmental agencies. Analyze complaints, petitions, motions, and pleadings for causes of action, potential defenses, and counterclaims. Draft briefs, motions and litigation documents, including Markman briefs for claim construction, summary judgment motions, Daubert motions, and appellate briefs. Counsel clients on federal, state and international data privacy laws. Analyze technical and financial documents to draft claims, licensing agreements; prepare arguments and presentations for hearings; and organize and manage trial exhibits. Maintain case calendars, ensure deadline compliance, and organize and maintain document files. Research, analyze, and discuss legal changes and implications on ongoing cases. Actively mentor junior associates as part of Firm’s initiative. Delegate legal and factual research appropriately to junior team members, legal assistants and practice assistants using effective delegation techniques. Take action to assist junior associates in managing their workload to resolve a scheduling or capacity issue where needed. Advise corporate clients on corporate transaction deal parameters and risks related to data privacy and cybersecurity. Advise companies on data privacy and cybersecurity compliance requirements and risk. Salary: $310,000-$390,000 peryear. Qualifications J.D., LL.M., or U.S. equivalent in law plus at least 3 years of professional experience as an Attorney, Associate, Law Clerk, or related occupation/position/title involving providing legal advice to corporate clients regarding commercial litigation, corporate transactions, IP and Data Privacy at an international law firm. Must be admitted to the California State Bar . Must also have experience with the following special skills: 3 years of professional experience providing legal advice to technology clients on data privacy issues and legal issues related to new products development; 3 years of professional experience in Intellectual Property litigation, including patent litigation, copyright right litigation and trade secret litigations; 3 years of professional experience providing data privacy counseling based on federal laws (COPPA, HIPAA, GLBA, and the FTC Act), state laws (CCPA, CPRA, and privacy regulations), marketing laws (CAN-SPAM Act and TCPA) and international laws (GDPR); and 3 years of professional experience advising clients regarding data privacy and cybersecurity considerations and risks presented in corporate transactions, including mergers & acquisitions, financings, and securities offerings.
